CHIP-IN GOLF, LLC FACILITY AND PRODUCT

I. PERMITTED USES; LICENSE GRANTED; PROHIBITIONS.  

You agree to use services and products offered by Chip-In Golf, LLC (the “Company”) only for lawful purposes and in strict compliance with the provisions set forth in these Terms and Conditions.  Your use of these services, products, and facility is at the Company’s sole discretion. The Company reserves the right to terminate or revoke your access and use of their property at any time, for any reason, or for no reason.  The Company reserves the right to block and prevent usage of this website by any person it so chooses.

II. TRADEMARKS.

The trademarks, trade dress, logos, and service marks shown on the Company’s website, facility, or other marketing material are owned by the Company and/or its affiliates.  Nothing contained in these Terms and Conditions will give you any right to use any of such trademarks, trade dress, logos, or service marks.

III. COPYRIGHT.

All content contained on the Company’s website, facility, or marketing materials, including without limitation, text, photographs, graphics, layouts and designs are owned by the Company.  The Company has a copyright on all materials contained on the Company’s website, its facility, and its marketing material.  No reproduction, distribution or transmission of any of the copyrighted materials contained on the Company’s  website, facility, or marketing material is permitted without the express written consent of The Company.  

IV. COLLECTION OF PERSONAL INFORMATION.   

The Company may collect personally identifiable information, including, but not limited to, your name and email address. The Company may gather additional personal or non-personal information in the future. Information about your computer hardware and software may be automatically collected by the Company when you access the Company website. This information can include: your IP address, browser type, domain names, access times and referring website addresses. This information is used for the operation of the service, to maintain the quality of the service, and to provide general statistics regarding use of the Company website. Individuals are responsible for providing the Company with accurate and complete personal information, and for contacting the Company if correction of such information is required. You may refuse to provide personal information or deny or withdraw consent to use personal information. If so, the Company may not be able to provide you with its services.

V. USE OF ALCOHOL.

Alcohol is permitted to be brought into and consumed in the Company’s facility. The Company will not provide alcohol. All consumption of alcohol on the Company’s property is at the customer’s risk. To the extent allowed by law, the Company cannot be held liable or responsible for the consumption of alcohol or any loss, damage, or injury that results from the customer’s consumption of alcohol. You agree to defend, hold harmless, and indemnify the Company from any and all injurie and damages caused by your providing alcohol to persons on Company property. 

VI. DISCLAIMER OF LIABILITY; DISCLAIMER OF WARRANTIES.  

The Company is not responsible or liable for any loss, damage, or injury incurred by you as the result of your use of the Company’s facility, products, or services. You are responsible for any damage caused by you to the Company’s property, including but not limited to, damage to the virtual reality equipment, golf clubs, or facility. The Company retains the right to full reimbursement for any damage to its property, including attorneys fees and court costs for the Company’s efforts in obtaining said reimbursement. You agree to defend, hold harmless, and indemnify the company from any and all injuries and damages caused by your providing alcohol to persons on company property.

THE COMPANY’S WEBSITE, FACILITY, PRODUCTS, SERVICES, AND THE CONTENT CONTAINED HEREIN ARE PROVIDED “AS IS” AND WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESSED OR IMPLIED.  TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, HABITABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.  THE COMPANY DOES NOT REPRESENT OR WARRANT THAT THE CONTENT CONTAINED ON THIS WEBSITE WILL BE CORRECT, ACCURATE, ADEQUATE, USEFUL, TIMELY OR RELIABLE.
